The Personal Admin Manager mobile application (PAM App) is owned and provided by PAM NZ Limited (NZ company number 8807988), having its registered office at 21 Rosetta Rd, Raumati, 5032 (“we”, “us” or “our”). These Terms and Conditions govern your use of the PAM App. By creating an account, accessing or using the PAM App, you are bound by these Terms. If you do not agree to these Terms, you must not use the PAM App.


Who Can Use the PAM App?

  • The PAM App is intended for personal, non-commercial use by families, or individuals. It is not intended for any commercial use by businesses.

  • You must be at least 16 years old to create and manage an account in the PAM App.

  • If you are under 16 years old, you may only use the PAM App with the supervision and consent of a parent or guardian.

  • Families may invite younger members to shared accounts at their discretion, but the primary account owner is responsible for managing access and monitoring appropriate and acceptable use.

  • Parents or legal guardians are responsible for any information about children that they choose to enter into the PAM App and for managing access to shared accounts on behalf of children.


Creating and Managing Your Account

  • To use the PAM App, you must create an account with a valid email.

  • Once you have created an account, you may invite family members or other individuals to join your account (Account members), enabling shared access to a single account. The primary account owner is responsible for managing permissions and access for invited account members

  • You are responsible for keeping your account credentials secure and not sharing them with unauthorized individuals.

  • You may delete your account at any time by contacting us at [email protected].

  • We reserve the right to suspend or terminate your account if you violate these Terms or misuse the PAM App.

  • If you do not use PAM within a 6 months period, all of your content and data can be deleted. Before this happens, you have the opportunity to take action in your account when PAM sends you Email notifications.

  • If your account is terminated or deleted, we will take reasonable steps to delete or de-identify personal information associated with your account, except where retention is required by law or for legitimate business purposes such as security, fraud prevention, or dispute resolution.


User Responsibilities

  • If you are the primary account owner, you are responsible for all content entered, uploaded or shared in your account, including content entered, uploaded or shared by any account members you invite to your account. You and your account members must ensure that all content complies with these Terms and applicable laws.

  • The PAM App uses AI services to help generate content based on your input. You acknowledge that AI-generated content may contain errors, omissions or inaccuracies and should not be relied upon as professional advice. You are responsible for reviewing and verifying any AI-generated content before using it.

  • You are responsible for any personal information (including private or sensitive information) you choose to input or share in the PAM App.

  • You agree not to submit, upload or share any harmful, offensive or unlawful content or any content that infringes third-party rights.


Permitted Use and Content Guidelines

  • Your content is visible only to your account members and, where necessary, to our support agents for troubleshooting or compliance purposes.

  • We may review, moderate or remove content that we consider is inappropriate, harmful, inconsistent with the PAM App’s purpose or in breach of these Terms.

  • You agree not to use the PAM App for spam, harassment, or unlawful activities.

  • We reserve the right to suspend access or cancel your account at our discretion if your use of the PAM App violates these Terms or any applicable law.


Intellectual Property Rights

  • We (and our licensors) own all intellectual property rights in the PAM App and any related materials, including the software, design, features, trade marks, and any related materials, assets, branding, marketing materials, and any other associated intellectual property.

  • We grant you a limited, personal, non-transferable, non-exclusive, revocable licence to use the PAM App solely for the purpose of personal and family organisation in accordance with these Terms. You may not copy, modify, distribute, reverse engineer, or create derivative works of the PAM App or any part of it.

  • You retain ownership of any content you create, upload, input or share within the PAM App. By submitting content in the PAM App, you grant us a non-exclusive, royalty-free licence to use, store and process the content for the purpose of operating and improving the PAM App.

  • Except for the limited licence above, these Terms do not grant you any rights in the PAM App or its intellectual property.


Modifications to the App

  • We may modify, update, discontinue or remove any part of the PAM App at any time, including features or functionality to improve performance, comply with legal requirements or for any other business reasons.

  • Where practicable, we will provide notice to you on our website or in the PAM App if changes significantly affect your experience.

  • We aim to keep the PAM App available and functioning, but we do not guarantee that the PAM App will always be available, uninterrupted or error-free. Access may be affected by factors beyond our control, including internet connectivity, third-party services, or technical issues. We may also need to suspend or limit access due to maintenance, updates or improvements.

  • Your continued use of the PAM App constitutes your acceptance of any modifications, updates or changes to the PAM App.

  • To the maximum extent permitted by law, we will not be liable to you for any loss, cost, or damage arising from or in connection with any unavailability, interruption, suspension, or restriction affecting the PAM App or any associated services.


Privacy

  • We collect and use personal information in accordance with our Privacy Policy, which is available at [website link ], the New Zealand Privacy Act 2020 and any other applicable privacy or data protection laws. By using the PAM App, you consent to the collection and use of your personal information in accordance with our Privacy Policy.

  • Content in the PAM App remains within your account and is not shared with other accounts or third parties except as is permitted under these Terms, our Privacy Policy, or as required by law.

  • We may enhance content to improve family support features, but except as set out above, we will not share such content externally without your permission and in doing so we will comply with our Privacy Policy.

  • Some features use automated tools or AI to improve functionality.


Fees, Payments, and Cancellations

  • We offer two subscription options as follows:

    • a free plan (PAM Free) which provides access to core features of the PAM App; and

    • a paid plan (PAM Family) which unlocks additional premium features.

  • New users of the PAM App are offered a 14-day free trial of the PAM Family paid subscription, giving access to all premium features at no cost. After the trial period ends, your account will automatically convert to the PAM Free subscription and will become limited based on the plan restrictions.

  • Details of the applicable fees for the paid PAM Family subscription will be provided before you purchase or subscribe.

  • Paid subscriptions are billed in local currency when purchased via the Google or Apple Store. For Stripe, users are billed in local currency when available, default to New Zealand dollars for locations not supported.

  • We may change our fees at any time, and we will provide reasonable notice to you before the change takes effect. Except as expressly stated in these Terms or as required by law, all fees paid are non-refundable.

  • We may introduce new paid features or subscriptions in the future, with reasonable notice.

  • Subscriptions automatically renew unless you cancel before the renewal date.

  • You can manage or cancel your subscription at any time within your account settings in the PAM App.

  • Cancellations within 3 days of payment may, at our sole discretion, be eligible for a refund. Requests must be made via [email protected] or via the help function within the PAM App.


Limitation of Liability

  • Except to the extent required by law, we provide the PAM App (including AI-generated content) "as is" without warranties.

  • Any network or data charges incurred while using the PAM App are your responsibility.

  • To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential loss or damage, including loss of data or revenue arising from your use of the PAM App.

  • To the fullest extent permitted by law, our total liability to you for any claims arising out of or relating to your use of the PAM App (other than liability we cannot exclude under New Zealand law) is limited to the amount you paid for the PAM App in the 12 months before the claim arose, or NZ$100 if you use the PAM Free version.

  • Nothing in this Section limits or excludes your rights under the Consumer Guarantees Act 1993 or any other applicable consumer laws or for any liability that cannot be excluded under New Zealand law.


Governing Law and Dispute Resolution

  • These Terms are governed by New Zealand law, and any disputes are subject to the exclusive jurisdiction of the New Zealand courts.

  • If you have a concern or dispute, you must first contact us at [email protected] so we can try to resolve the matter. We aim to resolve issues collaboratively, including for users outside New Zealand.

  • If the issue is not resolved within 30 days, either party may request mediation. Mediation will be conducted in New Zealand under the Mediation Protocol of the Arbitrators’ and Mediators’ Institute of New Zealand Inc (AMINZ) or similar rules agreed by the parties. The parties will agree on a mediator, or failing agreement within 5 working days, a mediator will be appointed by AMINZ. Mediation costs will be shared equally unless otherwise agreed. Nothing in this section limits your rights under the Consumer Guarantees Act 1993 or other applicable consumer laws.
